Terms of Service

The terms governing access to ATC's website, examinations, credentials, and public registry.

These Terms of Service ("Terms") govern your access to and use of the American Trade Certification ("ATC") website at americantradecertification.org and americantradecertification.com (the "Site"), our examinations, and our credentials. By accessing the Site, applying for a credential, sitting for an examination, or using the credential registry, you agree to these Terms.

1. About ATC

American Trade Certification is an independent, private credentialing body. ATC publishes competency standards, administers examinations through approved training providers, issues credentials to candidates who meet the standards, and maintains a public registry of credential holders. ATC is not a government agency, is not affiliated with any state or federal licensing authority, and ATC credentials are not licenses to perform regulated work.

An ATC credential signifies that the holder, on the date of examination, demonstrated competency against the published ATC standard for that credential. ATC credentials:

4. Use of the Public Registry

The ATC public registry exists to allow employers, contractors, training providers, and the public to verify the status of an ATC credential. You may use the registry only for that purpose. You may not (a) scrape or systematically extract registry data, (b) repackage registry data into a competing service, or (c) use registry data to harass or contact credential holders. ATC reserves the right to throttle or block access in response to abuse.

5. Fees, Payment, and Refunds

Examination fees are due before the examination is scheduled. Refunds are governed by the Refund Policy. ATC reserves the right to change fees prospectively; published fees apply to applications submitted before the change.

6. Examination Integrity

All ATC examinations are subject to the Examination Integrity Policy. Violation of that policy may result in invalidation of the candidate's result, revocation of any credential earned, and a permanent bar from future ATC examinations.

7. Intellectual Property

The Site, its content, ATC examinations, ATC competency frameworks, the ATC name and logos, and all derivative materials are owned by ATC or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works of any ATC examination content without written permission.

8. Disclaimers

The Site and our services are provided "as is." ATC does not warrant that the Site will be uninterrupted, error-free, or free of harmful components. ATC credentials reflect the holder's performance on a specific examination on a specific date; ATC does not warrant the holder's future job performance, fitness for any particular role, or compliance with any local licensing requirement.

9. Limitation of Liability

To the maximum extent permitted by law, ATC's total liability arising out of or relating to these Terms or your use of our services is limited to the amount of fees you paid to ATC in the twelve (12) months preceding the claim. ATC is not liable for indirect, incidental, consequential, or special damages.

10. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Tarrant County, Texas, and you consent to personal jurisdiction in those courts.

11. Changes

We may update these Terms from time to time. Material changes will be posted on this page with a revised effective date and, where required, communicated to active candidates by email.
